Terms and Conditions – Carter & Grace

Article 1 – Definitions

For the purpose of these Terms and Conditions, the following definitions apply:

Cooling-off period: the period during which the consumer may exercise their right to withdraw from the agreement.

Consumer: a natural person acting for purposes outside their trade, business, or professional activity, who enters into a distance contract with the trader.

Day: a calendar day.

Long-term agreement: a distance contract relating to a series of products and/or services, where delivery and/or performance takes place over a period of time.

Durable medium: any tool that allows the consumer or trader to store information addressed personally to them in a manner accessible for future reference and unchanged reproduction.

Right of withdrawal: the consumer’s right to cancel the agreement within the applicable cooling-off period.

Trader: the natural or legal entity offering products and/or services remotely to consumers.

Distance contract: an agreement concluded between the trader and the consumer through an organized system for remote sales, using one or more means of distance communication.

Means of distance communication: any method used to conclude an agreement without the trader and consumer being physically present in the same location.

Terms and Conditions: these general Terms and Conditions of Carter & Grace.

Article 3 – Applicability

These Terms and Conditions apply to all offers made by Carter & Grace and to every distance agreement and order placed between Carter & Grace and the consumer.

Prior to completing a distance agreement, these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, Carter & Grace will indicate where the Terms and Conditions can be accessed, and they will be provided free of charge upon request.

If the agreement is concluded electronically, these Terms and Conditions will be made available electronically in a way that allows the consumer to store them on a durable medium.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force. The invalid provision will be replaced with a valid provision that reflects the original intent as closely as possible.

Article 4 – The Offer

If an offer is subject to specific conditions or limited availability, this will be clearly stated.

All offers are non-binding. Carter & Grace reserves the right to modify or withdraw offers at any time.

Product descriptions and information are provided as accurately and completely as possible to allow proper evaluation by the consumer.

Product images are intended to represent the products accurately. However, minor variations or obvious errors do not bind Carter & Grace.

Article 5 – The Agreement

The agreement is established at the moment the consumer accepts the offer and fulfills the stated conditions.

If the agreement is accepted electronically, Carter & Grace will confirm receipt of the order electronically without delay.

In accordance with our order processing procedures, cancellations are only possible within 24 hours of placing the order, as fulfillment may begin shortly after. Once this period has passed, the order can no longer be cancelled. However, the consumer may still return the product within 30 days of delivery, subject to the conditions outlined in the Return Policy.

Article 6 – Right of Withdrawal

Consumers have the right to return their product within 30 days of receiving the order, without providing a reason.

During this period, the consumer must handle the product and packaging with care and may only use it to the extent necessary to assess its nature and functionality.

Return shipping costs are the responsibility of the consumer unless otherwise specified.

Refunds will be issued within 5 business days after the returned item has been received and inspected at our warehouse. Carter & Grace reserves the right to withhold the refund until the returned item has been received.

Article 7 – Costs in Case of Withdrawal

The consumer is responsible for the cost of return shipping.

Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed.
